These Terms of Service ("Terms") govern your use of the services provided by Refreshed MD ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

1. Definitions: "Services" refers to the cosmetic treatments, procedures, and related services offered by Refreshed MD. "Client" refers to the individual receiving services from Refreshed MD.

2. Services Provided: Refreshed MD offers a range of cosmetic treatments, procedures, and related services. These services may include, but are not limited to, facial treatments, skin rejuvenation, body contouring, and injectable treatments. The specific services provided may vary based on individual client needs and professional recommendations.

3. Professional Services: All services provided by Refreshed MD are performed by qualified and experienced professionals. Our staff is committed to delivering high-quality services using industry-standard techniques and equipment. However, results may vary depending on individual factors and we cannot guarantee specific outcomes.

4. Eligibility: Clients must meet the following eligibility criteria to receive injectable services with us:

1. Lip fillers are FDA approved for clients aged 21 and over. Clients aged 18 to 20 may receive lip filler with parental consent.

2. Neuromodulators are approved for clients aged 18 and over.

3. Dermal fillers are approved for clients aged 22 and over.

It is the client’s responsibility to provide accurate proof of age and any necessary parental consent. Certain medical conditions may preclude treatment, and it is the client’s responsibility to disclose their full medical history.

1. Consent to Treatment: Clients are required to complete all necessary consent forms prior to receiving any treatment at Refreshed MD. By completing these forms, clients acknowledge that they have been informed about the nature of the treatment, potential risks, side effects, and expected outcomes. No treatment will be administered without the completion of these consent forms. It is the client's responsibility to ensure that all information provided in the consent forms is accurate and complete. 

2. Risks and Limitations: Cosmetic treatments and procedures carry inherent risks and limitations. Refreshed MD will inform you about potential risks, side effects, and the expected recovery process. It is important to follow all pre and post-treatment instructions provided by our professionals to minimize any potential complications.

3. Client Responsibilities: Clients are responsible for providing accurate medical history and adhering to all pre and post-treatment care instructions. Pre and post-care instructions will be electronically sent to clients with each appointment and are also available in paper form and on our website at www.refreshedmd.com. It is essential for clients to follow these instructions carefully to ensure the best possible outcomes and to minimize any potential complications.

4. Privacy and Confidentiality: Refreshed MD respects your privacy and handles personal information in accordance with applicable laws and regulations. We maintain appropriate measures to protect the confidentiality and security of your personal data. 

1. Telehealth Services: If you engage in telehealth services provided by Refreshed MD, be aware that these services are conducted using secure, HIPAA-compliant platforms to ensure the confidentiality and security of your medical information. By using our telehealth services, you consent to the electronic communication of your personal health information. Clients are equally responsible for ensuring the privacy and confidentiality of their telehealth appointments. This includes selecting a private location and securing their own electronic devices to prevent unauthorized access. Please complete the telehealth consent form provided prior to your treatment.

2. HIPAA Compliance: Refreshed MD is committed to maintaining the privacy and security of your health information as required by the Health Insurance Portability and Accountability Act (HIPAA). Your health information will only be used and disclosed in accordance with applicable federal and local laws.

5. Payment and Cancellation: Payment for services rendered is due at the time of treatment, unless otherwise agreed upon. As a courtesy to our clients and our time at Refreshed MD, please provide a minimum of 24 hours notice should you need to cancel or reschedule an appointment. You will be charged a $100 cancellation fee, if an appointment is canceled less than 24 hours in advance; $150 or 1/2 of scheduled service (i.e. filler $350) if client is a no-show.

6. Modification and Termination: Refreshed MD reserves the right to modify or terminate any aspect of the services provided, including these Terms, at any time and without prior notice. We may also refuse or restrict access to our services for any reason, including but not limited to violations of these Terms or applicable laws.

7. Intellectual Property: All content and materials provided by Refreshed MD, including but not limited to text, images, logos, and trademarks, are protected by intellectual property rights, and remain the sole property of Refreshed MD. You may not use, reproduce, modify, or distribute any of our intellectual property without our prior written consent.

8. Disclaimer of Liability: Refreshed MD shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of our services. While we strive to provide accurate and up-to-date information, we make no warranties or representations regarding the accuracy, completeness, or reliability of any content or information provided.

9. Dispute Resolution: Any disputes arising out of or related to these Terms or our services shall be resolved through arbitration in accordance with the rules of the American Arbitration Association. In the event that a dispute proceeds to court, each party will be responsible for their own court costs and legal fees, unless otherwise ruled by the court Refreshed MD reserves the right to countersue for court costs and any related expenses incurred as a result of the dispute..

10. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state in which Refreshed MD operates.

11. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be in full force and effect.

12. Force Majeure: Refreshed MD shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, or other unforeseen events.

13. Entire Agreement: These Terms constitute the entire agreement between you and Refreshed MD and supersede any prior agreements or understandings, whether written or oral.
